Terms and Conditions

1. Introduction

Welcome to Santosha Hair, Face & Body. These Terms and Conditions govern your use of my website and the services I provide. By booking an appointment or using my services, you agree to be bound by these terms.

Santosha Hair, Face & Body is operated by Kathryn (“I”, “me”, “my”) and is located at Wynnum/Manly, QLD 4178, Australia.

2. Services

Santosha Hair, Face & Body provides a range of hair, scalp, facial, and wellness services including but not limited to hair styling and colouring, specialised scalp and hair treatments, Ayurvedic-inspired wellness rituals, organic facial treatments, Shirodhara therapy, Kansa Wand treatments, and pedicure services.

All services are subject to availability and may be modified or discontinued at my discretion.

3. Appointments and bookings

Making a Booking: Appointments can be made by phone on 0400 250 018.

Confirmation: All bookings are subject to confirmation and availability. I recommend booking in advance, particularly for longer treatments.

Arrival Time: Please arrive 5–10 minutes before your scheduled appointment time. This allows you to settle in and begin your experience in a relaxed manner. Late arrivals may result in reduced treatment time to avoid inconveniencing other clients.

Consultation: First-time clients and those receiving chemical services (such as colour treatments) may require a consultation and/or patch test prior to their appointment.

4. Cancellation and rescheduling policy

I understand that plans can change. However, as a small boutique spa, cancellations and no-shows significantly impact my business. I kindly request:

  • Cancellation Notice: At least 24 hours’ notice for cancellations or rescheduling.
  • Late Cancellations: Cancellations made with less than 24 hours’ notice may incur a cancellation fee of up to 50% of the scheduled service price.
  • No-Shows: Failure to attend a scheduled appointment without notice may result in a fee of up to 100% of the scheduled service price, and may affect your ability to make future bookings.
  • Repeated Cancellations: Clients who repeatedly cancel or fail to attend appointments may be required to pay a deposit at the time of booking.
  • I reserve the right to waive cancellation fees in cases of genuine emergency or illness at my discretion.

5. Pricing and payment

Current Pricing: Service prices are available on request and are subject to change without notice. I will confirm pricing at the time of booking.

Payment Methods: I accept cash, EFTPOS, Visa, and Mastercard. Payment is due in full at the completion of your appointment unless otherwise arranged.

Gift Vouchers: Gift vouchers are available for purchase and are valid for 3 years from the date of purchase in accordance with Australian Consumer Law. Gift vouchers are non-refundable and cannot be exchanged for cash.

Deposits: For certain services or packages, a deposit may be required at the time of booking. Deposits are non-refundable but may be transferred to a rescheduled appointment with adequate notice.

6. Health and safety

Consideration for Others

To help maintain a calm, hygienic, and restorative environment for all, I kindly ask that anyone who is unwell, including both clients and children, is not brought into the studio. This includes symptoms such as coughs, colds, fever, or other contagious illnesses.

If you or a child in your care are unwell, please contact me to arrange an alternative appointment time. I am always happy to support rescheduling in these circumstances.

Thank you for your understanding and for helping me care for the wellbeing of everyone in my space.

Client Responsibility: For your safety, please inform me of any medical conditions, allergies, skin sensitivities, pregnancies, or medications that may affect your treatment. This includes but is not limited to skin conditions, recent surgeries, heart conditions, epilepsy, and allergies to products or ingredients.

Patch Tests: Patch tests are required for certain chemical services such as hair colour. I require a minimum of 48 hours between the patch test and your appointment. If a patch test is not conducted, I reserve the right to refuse the service.

Contraindications: Certain treatments may not be suitable for all clients. I reserve the right to modify or refuse a service if I believe it may pose a health risk.

Illness: For the wellbeing of my clients and staff, please do not attend your appointment if you are unwell with a contagious illness. I will waive cancellation fees in such circumstances with reasonable notice.

Results: While I strive to achieve the best possible results, individual outcomes may vary based on hair type, condition, history, and other factors. I cannot guarantee specific results.

7. Products

Retail Products: I offer a selection of professional hair care and skincare products for purchase, including Eminence Organic products. Product recommendations are made based on your individual needs.

Product Returns: Unopened products in original condition may be returned within 14 days of purchase with proof of purchase for exchange or store credit. Opened products cannot be returned unless faulty.

Allergic Reactions: If you experience an adverse reaction to a product purchased from me, please discontinue use immediately and contact me. I recommend patch testing new products before full use.

8. Liability

General Limitation: Santosha Hair, Face & Body takes all reasonable care in providing my services. However, to the extent permitted by law, I am not liable for any loss, damage, or injury arising from the use of my services or products, except where such liability cannot be excluded under Australian Consumer Law.

Consumer Guarantees: Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted, or modified by agreement.

Personal Belongings: I am not responsible for loss or damage to personal belongings brought onto my premises. Please keep valuables secure.

Service Modifications: If you are dissatisfied with a service, please advise me as soon as possible. I will endeavour to address your concerns and, where appropriate, offer a complimentary correction service within 7 days of your original appointment.

9. Privacy

Personal Information: I collect and use your personal information in accordance with my Privacy Policy and the Australian Privacy Principles. Information collected may include your name, contact details, health information relevant to treatments, and service history.

Use of Information: Your information is used to provide my services, communicate with you about appointments, and improve your experience. I do not sell or share your personal information with third parties for marketing purposes without your consent.

Marketing Communications: From time to time, I may send you information about my services, promotions, or events. You may opt out of marketing communications at any time by contacting me.

Data Storage: Your information is stored securely and retained only for as long as necessary to fulfil the purposes for which it was collected, or as required by law.

10. Intellectual property

All content on the Santosha Hair, Face & Body website, including text, images, logos, and design elements, is the property of Santosha Hair, Face & Body or its licensors and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or republish any content from my website without my prior written consent.

11. Website use

Accuracy of Information: While I endeavour to keep my website up to date, I do not warrant that the information is complete, accurate, or current at all times.

Third-Party Links: My website may contain links to third-party websites. I am not responsible for the content, accuracy, or practices of these external sites.

Service Availability: I do not guarantee that my website will be available at all times or that it will be free from errors or viruses.

12. Children

Children under 16 years of age must be accompanied by a parent or guardian. Certain services may not be suitable for children, and parental consent is required for any chemical treatments on minors.

13. Conduct

I am committed to providing a peaceful, relaxing sanctuary for all clients. I reserve the right to refuse service or ask clients to leave if their behaviour is disruptive, disrespectful, or poses a risk to my safety and comfort or that of other clients.

14. Changes to terms

I reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective when posted on my website. Your continued use of my services after any changes constitutes acceptance of the updated terms.

15. Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these terms or my services will be subject to the exclusive jurisdiction of the courts of Queensland.
